MagicApp (hereinafter referred to as the 'Company') sets forth this Privacy Policy (the 'Policy') regarding the handling of users' personal information in the services provided on this website (the 'Services').

Article 1 (Personal Information)

'Personal Information' refers to 'personal information' as defined in the Act on the Protection of Personal Information of Japan, meaning information about a living individual that can identify a specific individual by name, date of birth, address, telephone number, contact information, or other descriptions contained in such information, as well as data related to appearance, fingerprints, or voiceprints, and the insurer number on health insurance cards or other information that can identify a specific individual by itself (personally identifiable information).

Article 2 (Methods of Collecting Personal Information)

When users register for use, the Company may ask for personal information such as name, date of birth, address, telephone number, email address, bank account number, credit card number, and driver's license number. The Company may also collect transaction records and information related to payments, including users' personal information, from the Company's partners (including information providers, advertisers, ad distributors, etc.; hereinafter referred to as 'Partners').

Article 3 (Purposes of Collecting and Using Personal Information)

The purposes for which the Company collects and uses personal information are as follows:

  • To provide and operate the Company's Services
  • To respond to user inquiries (including identity verification)
  • To send emails regarding new features, updates, campaigns of the Services in use, and information about other services provided by the Company
  • To contact users as necessary for maintenance and important notices
  • To identify users who violate the Terms of Use or attempt to use the Services for fraudulent or improper purposes, and to refuse their use
  • To allow users to view, change, or delete their registration information and view their usage status
  • To bill users for fees in paid services
  • For purposes incidental to the above

Article 4 (Changes to the Purpose of Use)

The Company shall change the purpose of use of personal information only when it is reasonably deemed to be relevant to the purpose before the change.

If the purpose of use is changed, the Company shall notify users of the changed purpose by the method prescribed by the Company or publicly announce it on this website.

Article 5 (Provision of Personal Information to Third Parties)

Except in the following cases, the Company will not provide personal information to third parties without prior consent of the user; provided, however, that this shall not apply where permitted by the Act on the Protection of Personal Information or other laws and regulations:

  • Cases in which it is necessary to protect a person's life, body, or property and it is difficult to obtain the person's consent
  • Cases in which it is particularly necessary to improve public health or promote the sound growth of children and it is difficult to obtain the person's consent
  • Cases in which it is necessary to cooperate with a state institution or a local public body, or an individual or entity entrusted by either of the foregoing, in executing affairs prescribed by laws and regulations, and obtaining the person's consent may impede the execution of such affairs
  • Cases where the following matters have been announced or publicly disclosed in advance and the Company has notified the Personal Information Protection Commission (including: that the purpose of use includes provision to third parties; the items of data to be provided to third parties; the means or method of provision to third parties; that provision to third parties will be ceased at the request of the person; and the method for accepting such requests)

Notwithstanding the preceding paragraph, in the following cases, the recipient of such information shall not be considered a third party:

  • Cases in which the Company entrusts all or part of the handling of personal information within the scope necessary to achieve the purpose of use
  • Cases in which personal information is provided as a result of the succession of business due to a merger or other reasons
  • Cases in which personal information is used jointly with a specific person and the person has been notified in advance, or is in a readily accessible state, of the items of personal information to be used jointly, the scope of joint users, the purpose of use by the users, and the name or title of the person responsible for the management of the personal information

Article 6 (Disclosure of Personal Information)

When a person requests disclosure of personal information, the Company shall disclose it to the person without delay. However, if disclosure falls under any of the following, the Company may not disclose all or part of it, and if a decision is made not to disclose, the Company shall notify the person without delay. A handling fee of 1,000 JPY per request will be charged for disclosure of personal information.

  • If there is a risk of harm to the life, body, property, or other rights or interests of the person or a third party
  • If there is a significant risk of hindrance to the proper execution of the Company's business
  • If it would violate other laws and regulations

Notwithstanding the preceding paragraph, in principle, the Company will not disclose information other than personal information, such as history information and characteristic information.

Article 7 (Changes to the Privacy Policy)

Except as otherwise provided by laws and regulations or in this Policy, the contents of this Policy may be changed without notifying users.

Unless otherwise specified by the Company, the revised Privacy Policy shall take effect when it is posted on this website.

Article 8 (Suspension of Use, etc. of Personal Information)

If the Company is requested by a person to suspend the use or delete ('Suspension of Use, etc.') personal information on the grounds that the personal information is being handled beyond the scope of the purpose of use or that it has been obtained by improper means, the Company shall conduct the necessary investigation without delay.

Based on the results of the investigation in the preceding paragraph, if the Company determines that it is necessary to respond to the request, the Company shall implement the Suspension of Use, etc. of the relevant personal information without delay.

If the Company has implemented the Suspension of Use, etc. based on the preceding paragraph or has decided not to implement the Suspension of Use, etc., the Company shall notify the user without delay.

Notwithstanding the preceding two paragraphs, if the Suspension of Use, etc. would involve a large amount of cost or otherwise be difficult to implement, and if alternative measures necessary to protect the rights and interests of the user can be taken, the Company shall take such alternative measures.

Article 9 (Changes to the Privacy Policy)

Except as otherwise provided by laws and regulations or in this Policy, the contents of this Policy may be changed without notifying users.

Unless otherwise specified by the Company, the revised Privacy Policy shall take effect when it is posted on this website.
